Accidents at Work

Accidents at Work Lawyers in Ontario

If you are injured in the workplace you may be able to start a court action against your employer if they are not registered with WSIB.

About Accident at Work claims

Some employers have coverage for Workplace Safety Insurance Board (WSIB) in the event that an employee is injured while working. Not every employer is registered for WSIB coverage.

Employees who are injured at work that do not have access to WSIB benefits should contact a lawyer as a lawyer will provide advice with respect to what type of compensation they may be eligible for including loss of wages.

The lawyers at Aaron Waxman & Associates have experience helping clients who have been injured in the workplace due to non-WSIB related claims.

Answers to commonly asked questions

  • What should I do if I’m injured at work?

The two most important things to do after an accident at work are to notify your employer and to see a doctor as soon as possible. A doctor can document and diagnose your injury, as well as provide treatment options (if applicable).

  • If I’m covered by the WSIB, can I still file a lawsuit?

If your employer is covered by the WSIB you aren’t allowed to sue your employer if you’re injured at work. However, if the WSIB denies your claim, an experienced employment lawyer can determine whether or not a claim can be made.

  • What if I can’t go back to work?

If you are unable to return to work as a result of your workplace accident then you may be entitled to short-term disability and long-term disability benefits.

  • What happens if I can’t go back to my regular job?

If your workplace accident prevents you from going back to your regular job, your employer may be able to offer you an alternative role, depending on the job.
