Chronic Fatigue Syndrome and LTD claims

A claim for long-term disability benefits may arise from an injury or illness and the illness can be a psychological or physical illness, or a combination of both.



Chronic Fatigue Syndrome (CFS) is an illness that may render a person unable to work.

CFS is a complex disorder that is characterized by extreme fatigue unexplained by any underlying medical condition. The fatigue associated with CFS can worsen with physical activity and may not be diminished or improve with rest.


No single test can diagnose or prove that a person has Chronic Fatigue Syndrome.


According to the Fibromyalgia-Chronic Fatigue Syndrome (FM-CFS) Canada Compassion in Action website, CFS is also known as Myalgic Encephalomyelitis and is a complex and serious illness that affects many body systems. Due to persistent fatigue, CFS causes a reduction of previous levels of activity. According to the FM-CFS site, in order for a diagnosis of Chronic Fatigue Syndrome to be made, a person has to meet specific criteria.


  1. Medically observed, persistent or relapsing chronic fatigue that is not the result of ongoing exertion that is not alleviated by rest resulting in substantial reduction of previous levels of occupational, educational, social or personal activities and;
  2. Meet 4 or more of the key symptoms associated with CFS, which are impairment in short-term memory or concentration, sore throat, extreme joint and muscle pain without swelling or redness, headaches of a new type, pattern or severity, unrefreshing sleep, painful lymph nodes, post-exertional malaise lasting more than 24 hours.


CFS involves symptoms that last more than 6 months. CFS could develop as a result of acute infections, respiratory or gastrointestinal infections or emotional or physical traumas. It could also be caused by immune dysfunction, nutritional deficiency or low blood pressure.


As a result of ongoing fatigue and other symptoms associated with CFS, a person may experience difficulties with the essential tasks of his or her occupation and require a prolonged absence from work, resulting in a long-term disability claim.
